CHANGE IN THE LAW
Under the Healthy Workplaces, Healthy Families Act of 2014, California became the second state to provide paid sick leave benefit beginning  July 1, 2015.   The new law applies to  all employers, regardless of size and covers part-time and full-time employees. The employee simply needs to have worked in California for 30 or more days within a year from the commencement of employment. Four groups of employees are not covered, but these groups are very narrow.  There are several methods to determine the amount of sick leave earned but employers must compensate employees with sick leave pay at their hourly wage.
Unlike unused or accrued vacation, sick leave under the Act does not need to be paid out at the end of employment.  The law is complex. If you have specific questions about the application of the law please consult us.
